Workaround 1 has for me the disadvantage that e.g. for the following setup 
(lower layer first)

    Satellite Image
    Polygon

the satellite image always appears as in a haze because of the interference 
with the polygon layer, as the polygon interior is never entirely 
transparent.

I did not really understand your second suggestion, but I would not want to 
have two layers for displaying the same data either, as this would require a 
user to always click two boxes...

However, understanding the underlying mapserver limitation, I have converted 
my polygons into lines, so the opacity issue does not arise anymore.
